    It was in response to the many posts about a possible 3rd party deal and what is required under the ASX Listing Rules. The link is to an ASX abridged version of the ASX ruling for anyone who wants to ring the company and seek information on what they think might be going on. FMS can update the market of the presence of a 3rd party deal they just don't have to disclose the details, even an interim MOU or LOA would assist with many queries.

    That's the non-existent pot, I don't believe there is a 3rd party deal in the wings and sitting it out until the November AGM so a vote can be cast on the Remuneration Report to try and force a board spill is (a) premised on the wrong grounds and may be contested by the Directors as a vote against the Remuneration Report is not the real issue and it is being used as a defacto trigger besides the fact that sitting and doing nothing for 6 - 7 months at the current cash burn rate is an expensive, passive way of bringing the non-performance issue of FMS to a head, an EGM can be called in the interim to trigger the same effect if there is no 3rd party deal of substance and calls for new Board nominees can be sought.
