It's a bit hard to tell from this report whether Lion will be allowed to alter the pleadings to include "scrutiny" of A2M's claims. The judge said it "would be a game changer" and wasn't covered in the pleadings, so presumably it has yet to be argued and decided whether this will be admitted. The report does not say outright that Lion/Pura will challenge the science, just that it will scrutinise it.

I'm not a lawyer, but it seems to me the argument before the court is over whether customers were misled by the labelling, which they were. They believed they were buying milk that gave them the reputed benefits of A2. Even if there was some scientific doubt as to the reputed benefits of A2 milk, they had a right as consumers to buy milk that gave them the benefits they sought, and not be misled into buying a product that did not.
