Melbourne13. The thing that I have absolutely no understanding of is a combination of how far the recalcitrant counterparty is prepared to push his luck and how long management is prepared to put up with his delaying tactics.
The only thing I can say to be "reliable" is that the initial claim is totally unreasonable and "if" management sees that it is getting nowhere by being "nice guys" no Land Council will give the claimant the time of day.
We must also keep in mind that they are only 2 months max before the wet season starts!!
I'd be amazed if management let's it go much longer, if they can't see some waivering on behalf of the claimant then they will certainly weigh up the comparative cost of the Land Council and the time before it is heard.
And in saying that, I have no idea if this can be settled in those processes, we have a deceased estate involved that could create untold complications. Yes, it's all about how difficult the claimant who is holding out WANTS to be.
Until then, keeping in mind that there are $millions in lost income for very many people involved resulting from this delay, from the company and its shareholders and all the relevant contractors, I'm sure that all factors would be being weighed up as we speak.
