Sorry, I have to jump in here, but only because I don't want everyone thinking they have this "legal right" to record when no such right exists. I have looked into this issue previously, and this is what you need to know:
- An AGM is a private meeting the terms of attendance of which may be set by the company's directors. In this case, the directors can impose any conditions of attendance as may be reasonably required. A request not to record proceedings without the directors' consent is a reasonable request.
- It is also an offence in WA to record a private meeting by audio or audio-visual recording device without consent of ALL the parties' to that meeting.
There you have it. No recording. Furthermore, rest assured there is likely to be an explicit condition imposed at the outset of the meeting by the directors that there is to be:
- no recording;
- no photographs being taken.
If you don't wish to abide by those conditions, then you breach the conditions of attendance and you should vacate the premises.
You have been warned.
