I very much doubt that at age 31 you have that experience. Tax accountants are not willing to pour their clients' money down the drain. If you are an ordinary taxpayer, you are unlikely to be able to litigate even if your minimisation idea is legal but it is challenged by the ATO. It is therefore often a case of better be safe than sorry.
