Yes, there is no way he could possibly know the out come of the trials, or predict the future share price. He would of course have access to company specific figures such as revenue growth, costs and othe financial information. I don't know how long before the trial results or the release of other price sensitive information he might be barred from trading, but that is a consideration. As you say, that trading window might be quite short.
