Yes there is definately competition going on, which would break the non-compete clause I guess! But Sileach processes Spodumene which L-Max can't do, so is that tackling a different problem rather than competing on the same problem? Is that agreement available online anywhere? I'm pretty interested to have a look.
What if the judge says 'ok LIT, you have to stop working on sileach but you get to keep your exclusivity for L-max in Cinovec'. Is that possible?
The other possible ruling might be 'you broke the non-compete clause so your L-Max licenses are void, but you can still work on sileach without paying royalties to LPD'.
The third option would be 'Ok LIT, you broke it, you lose your L-Max licenses and Sileach infringes L-Max IP so you have to pay royalties to LPD'.
Not sure which way it would go yet... thoughts?
