Would anyone be happy if they had not disclosed an intention of a legal threat, that was unquantified at the time of receipt. They would have needed at least a few hours to consult with their legal team.
If they had not asked for a TH, and the legal team after reviewing the situation announced that there would be a possible significant amount in play, what do you think the SH would have said about the Board for non-disclosure.
SRX acted appropriately in this matter, IMO.
