    I noticed some typo's in my first draft :

    The ideal circumstances for taking up the buyback are :

    1) Low MTR
    2) High cost base
    3) Availability of realised capital losses for a bit of tax harvesting, and the same time reset you Cost Base at a higher level for future disposal

    But even under that scenario you will need some luck, considering that you are certain to receive 14% below BHP's prevailing market price, and by the time the dust settles, BHP could get away from you permanently as far as market price goes (ie sharp increase)
