It really is impossible to have any opinion on the two cases due for mediation next month. Mediation turns on the strengths of the each side's case yes, but also on the danger of proceeding beyond mediation to the expensive, winner take all domain of a final hearing, which is subject then to the potential further uncertainty of an appeal.
The realisation that this drawn out process awaits if settlement is not reached at mediation can be sobering for all sides, and means we can't dismiss the idea of settlement. Given as well the guidance given by JKL, one must remember that they have significant control in the mediations to steer things to settle to meet their forecast.
That all said, no idea of the strengths of our case and yes this is in the realm of serious opponents with resources to burn on endless litigation so no illusions that we can bully a favourable settlement. If their offers are poor, what can we do but press on with the fights. All the while though, we have $5m EBITDA from the disbursement biz and a bugger all market cap
