If you read what he said at all, you would notice he states that it clearly reads in the announcement:

'AS PART OF THIS SETTLEMENT, CMY RETAINS THE RIGHT TO FURTHER INVESTMENT IN BCC'

Nothing to do with two years ago & everything to do with the settlement with BCC that occurred little over a month ago with a cash settlement

A further investment implying one may have already been done. This all stated in the ASX query.
