would you really expect sgh to refute any comments made by wtg in any forum but the courts or in private discussions given they said they would not be making any comments about the merits of the claim except that it would be pursued vigorously? so the fact they haven't doesn't mean much imo. i also think it is a big assumption you make, that the barrister 'holds all the evidence' relating to the fraudulent misrepresentation claim, but that is your prerogativeand yes, so i think it's true we all make choices as to how much weight we apply to the hazy set of facts available..
