Disgusting policy from the ATO.
Do they have nothing better to do then arbitrarily interpret the tax code.
It should be viewed as a completely legitimate form of tax avoidance.
If they don't like it they should change the law.
ATO doesn't give investment advice, so why the hell should they be concerned when someone chooses to sell and buy.
