Sometimes these things do go to court, but most seem less likely to launch legal action knowing the other side also has a good team of lawyers - experienced in that type of case.

A little joe forum poster .. much easier to 'ask nicely' to cease and desist and/or go nuclear. So the small fry are easier targets.
