It depends on how you look at it. With the warrants and debentures issued we wouldn't be, but as many of them, if any, haven't been converted to shares you could say that we are. In a fully diluted sense I would say that we are not but I haven't done the maths to work out where we sit. As @Squizzed said, I do my numbers on the number of shares MMJ hold rather than work out a percentage of ownership.
