NOT exactly sure of your point Rapier, but as of Nov.11/07, CXY has a binding ageement (MOU) with Ergo:

and it is purely supposition on our part, that the subject agreement precludes Ergo dealing as far as the tech is concerned, with other parties within the Australian sovereignty and other specific areas.
afterall,
Ergo will be benefitting from Len Walker's vast pool of past knowledge and hands-on experience, so it might have been expected that there were stringent lines drawn in the sands prior to the signing of that MOU.
however,
we are not familiar the agreement as to whether, or to what extent the same applies to CXY's dealings with other Co's who may wish to become end users, and thus benefit from use of the tech. or combined IP of CXY and Ergo, going forward.
