In a B2E / B2B model SAAS agreements generally are binding as organisations expect a certain service (usually customised) for how their data is handled and how quickly they expect the vendor to respond to them when something goes wrong. This also includes enterprise licensing arrangements that have periods of engagement defined.
Also every application you've ever used requires some form of infrastructure to run on - be it cloud, virtual machines, or physical machines. Without infrastructure how do you suggest the application runs & stores data?
