just because its going to court is of little relevance in terms of how the facts will play out. As you note it comes down to "their bill" and no more or less than that. Both legal reps get paid irrespective to the outcome. I'm sure CHM's would have asked for an advanced retainer though.
IMO massive upside for holders if there are some cloudy facts. But this is what you're punting on.
