As is customary in this style of deal, Harbour would have signed a Confidentiality Agreement to access the data room. In this CA, it would be normal to have a "no share purchase" Clause, which would preclude them from doing as you suggested.
In any case, the data they have would obviously be market sensitive, which would mean they are Insiders in accordance with the Corps Act.
