DB isnt 'the Hoff' an independent arbiter and therefore unbiased and not in FAR's corner. He has simply been appointed by FAR from an approved list of potential arbiters. He is more like an independent judge that sits on the panel and considers the facts/arguments rather than a lawyer acting for one party.
I believe the arbiters are paid via the ICC rather than their respective appointers and that is the way it should be to avoid conflict.
From what I can gather to get on the ICC list of potential arbiters you must be free from any bias and must assess each case on its merit and cannot favour any party.
That is, FAR must convince Hoff that there case has merit just like they must convince one of the other panel members to claim victory.
Theoretically the Hoff could be the only one that votes/finds against FAR and FAR could still win.
What is the point of having three members on the panel if two have already made up their minds in opposite directions? Might as well just appoint them as lawyers and have just a One member panel that needs convincing either way.
