Here's a tip: maybe I know a bit more than you on this topic. Most people are lucky because companies are generally more interested in looking forward than looking back and have other fish to fry.
But if I were the CEO I would be feeling justifiably peeved at the attacks which have gone on in here, particularly about bona fides and Director's duties, and in particular the obligation to put the interests of shareholders first.
The company cannot sue in it's own right when it has beyond a certain number of employees, but Directors most certainly can. They can sue at any time, in their own right.
As you will recall, I said that the Board would no doubt be working on a solution. Clearly they have been.
There is more than a single issue here. I am not going into it in any detail but I strongly suggest the following:
