Let's say this much. If WPL had an arrete which proves ownership of the asset, how easy would it be to stick to it. But they have not published anything (Which they probably would not need to) but sound a bit shaky atm, i.e.the Board wants to have proof of ownership before committing large funds, which is in the public arena. It's not really about FAR's opinion, it's WPL's uncertainty.
