Thank goodness for that. A sign of life from the Tribunal.

Just this morning, I unearthed the case of Hong Huat Development Co (Pte) Ltd v Hiap Hong & Co Pte Ltd. These parties had the misfortune to wait more than ten years after conclusion of arbitration hearings for an award to be released.

In a subsequent appeal for setting aside, the Singapore Court of Appeal ruled that, while the delay in issuing the award was “grossly inordinate” and apt to “undermine faith in arbitration”, it was nonetheless not a sufficient basis for setting aside the award.

Not wishing to undermine faith in arbitration, I’m sure the SIAC found a way to exclude this particular case from its calculation of median and mean durations of cases.
