When the CGT event occurs has nothing to do with when or who receives the money
Everything will come down to the precise wording in contracts as to what has happened but based on what I have seen this is the likely out come
Purchase date and cost will be the normal inital date and cost
Transferring the shares to Opes and the subsequent transfer to ANZ will have on CGT effect
The sale of the shares will trigger a CGT event and will be treated as a sale by the inital investor and a potential CGT liability to the investor, not recieving the funds will not be a relevant factor.
The investor maybe able to claim a capital loss in relation to the loss incurred in relation to the contract with Opes however this will not happen until it is clear they will receive no funds or only a portion of their funds back
So a CGT liability on the sale of the share in this year and a loss in relation to the contract with Opes which maybe in this year or could be in 3 years time
