Of course the Takeovers Panel may exercise their rights by dismissing the claim altogether.
But at the very least they will refer themselves to the very informative Guidance Note that they themselves have written and released on the matter which can be found at the following link:

Now this guidance note doesn't provide an exact answer to the situation, but is worth reading and contemplating on by any of us to reach our own conclusions on how the Panel may react and respond.
