This was part of the "last minute" or surprise arguments that the ATLA legal team brought in, and the defendants were not prepared to go into detailed evidence about the validity or historical evidence of this story line. But given that these concerns weren't mentioned in any of the 2016 and 2017 clearance survey and consent paper work then I expect they will be better prepared in future, if it somehow does end up back in court.
