1. Appeal action still feasible - Yes
2. Chance the Flare may fail completely - Nil. Which is the same chance I give Yurlu/Yulu and Vince appearing as a witness in the appeal referred to at '1.'
a. Noted RMIT experts merely sent a letter of concerns (after being requested {paid?} to send such letter)to lawyers of environmental group William Light Foundation (who were not the recent litigants????). These professionals were not so concerned as to see fit to make an official submission. My understanding is that their letter contained generalisations and in no way referenced a localised geological/groundwater study.
The Minister responded:
'I invite the RMIT academics to submit to the next round of community, environmental and Aboriginal heritage consultation on this project.'
They did not.
b. Clutching at straws.
c. Any 'Mishaps' will be investigated appropriately.
