If they get the exchange off the ground with no issues, in the scheme of things $33k will be nothing.
Better off to get it out of the way and move on, having this hanging over our heads is only more bad publicity, especially when they are trying to get people to use their exchange.
The last paragraph of the announcement reads as if they will be paying it soon, but not admitting any fault.
