That's not how IP works. Once a patent expires, anyone can use it. The information is in the public domain and is no longer protected.

However, AGY have been very careful in showing virtually nothing about their process. The pilot plant photos to date do not provide any sense of the process details - deliberately. Can you see what plumbs to what? What resins and eluents are used? Sure, we can have a guess - we all can (I have worked in the chemical industry with IX etc, although not in this industry). But we are guessing. The PEA has given away nothing. It's your perogative not to believe in the viability of the project without really knowing anything about it. Me - I'm happy to wait for the preferred O/T's view at the money end of this.
