Yes, you're reading it correctly - the shareholders are fighting back. 

This TOV application along with Jonathan Shapiro's article have both been in the pipeline for a while.  I couldn't say whether the timing is coincidental, strategic, or just the way these things happen. With the number of avenues shareholders have been pursuing, I'd expect a few more developments in the coming weeks.
