I'll retract that first part as they go on to refer back to the 2015 Samarco dam fail, however they say it could have implications of the settlement of that dam break due to the current failure and may have a material effect on BHP due to the continuing court cases that involve Vale in that joint venture.
I'll put it down to my interpretation of the reported news.
