I would say the get out of jail clause could be the fact that they won't comply with chapters 1 & 2 of the ASX listing rules. This is stated in the original MOU.

The question is what is ALEX going to do next(if anything) and when(how long does he give this)?

I think someone has mentioned before that maybe the saving grace is the fact he has so many shares that he may want to keep this thing going with another opportunity.
