From what I understand, and I could be wrong, the DPP could have appealed the NSW Court of Criminal Appeal's decision to quash the convictions, and to do that it'd have to take it to the High Court and they'd need evidence that the NSW Court's decision was erroneous. The DPP has elected not to do this as they don't have any grounds for such an appeal. However, the quashing still leaves open the opportunity for the DPP to go for a retrial of MacDonald/Maitland in 2020, should they choose to do so (which seems highly unlikely).
