The Walter Bau case was a real drawn out saga fought and appealed on various technical issues, including jurisdictional arguments under the BIT. Thai Government eventually showed good faith and paid but its noteworthy that it took a change of PM (Thaksin) for it to happen.

The factual basis of our case against Thailand PM is significantly cleaner with both parties already agreeing to the arbitration proceedings itself so less procedural issues will likely arise post hearing. There is no right if appeal once an award has been made under TAFTA so the Thai Government will have no option but to pay or face alternative enforcement mechanisms whilst dragging their international reputation into the mud. A removal of the current PM who has given himself power in excess of most dictators wouldn't harm our cause!!
