Question is, what is least embarrassing outcome for ACCC? Backtrack on their original concerns or Courts to overturn yet another of their decisions? Personally I would go with option 1 and cite cancellation of TPG mobile network as excuse to save some face. Perhaps they would prefer to play the good guy and let the Court overrule but then they risk being seen as a redundant government agency.
