    I disagree - my reading is that once the additional $2.9M is paid CDX can claim to own 40%+. The fact that they announced they don't own more than 40% means it hasn't been paid - even if they did declare its going to occur post-haste. Ownership could be in the form of shares or notes - you can own the company as a shareholder or bond-holder/ debt. (Obviously voting rights, etc are different for each class of owner). That's my read.
