Two of the arbitrators started off as being "biased" - they're the two I understand that FAR and COP selected each. But all three by now would be intimately familiar with the documentation/arguments and I suspect that one of the initially "biased" arbitrators may be thinking that something similar to a plea bargain may be the wisest course if available.
