the following is only my opinion based on what I have heard from others who are not experts in the field...so i could be totally wrong from a legal standpoint...so suggest you check it out with your solicitor
netting off applies in determining pro-rata payouts to creditors in a liquidation scenario...which is yet to occur...this thing is still in administration...and if it stays in administration via a DOCA then netting off should not apply
but under the other scenario suggested, whereby ANZ agreed to buy out client positions in order to settle in return for clients giving away legal rights, in a room without FH...netting off provisions may apply to the payout
