Many class actions in the financial world basically ground on the following:

”Allegations: During the class period, Xxx Company. made materially false and/or misleading statements and/or failed to disclose...”

It’s for the class and the plaintiffs lawyers to consider if the evidence would make for a good case. This has nothing to do with a safe harbour statement in a mandatory exchange release. If the class thinks they can prove that statements were misleading (mind: thats not an easy task to accomplish and needs very thorough assessment) then they go ahead. The battle in court will be vehemently fought from both sides, but thats how these things go.
