So far asic has not gone to court to establish what the service obligations or more importantly what evidence is required to prove clients were offered services. Instead the industry just paid up - way too much in cases where the clients were happy that were offered services.
It was too too easy for the bank CEOs to just say I am sorry and move on by exiting advice.
