SPX Chairman had been involved in talks with Penney west holders 18 mths BEFORE the acquisition.
VMC came on the scene much later than SPX.
Serious doubt about any validity to claim due to this factor. Its a scam run against us by VMC directors to appease VMC shareholders with little change of even getting to court. Mediation only outcome.
Personally SPX directors should go after VMC with big guns. Counter sue for losses by share holders etc.
