i think the answer is that chm does have a claim against the original amount of money (which really isn't much) but (as mmx has consistently maintained) no claim against Jack Hills etc. so it makes sense for mmx to go to mediation to offer to pay back the original money as settlement. chm will reject this and then it will go back to court but mmx's has strenthened its position by offering a solution that chm has rejected. it has also wasted time and money that chm dosn't have. i still believe that even if by some chance chm won completely they would owe so many so much and have so many shares on issue that the benefit per share of the win will not have been worth all the trouble.
