Do they have two brains each? No? Bipolar? No? They signed with a sound mind that’s why they’re in court lol. Can you argue in court for selective amnesia? Like every time I attend a spx bod meeting, I forget everything else or don’t think of any and all the information I gained from DJC’s business?

On other comments of posters:

‘Mr H has been coveting PW for years.’ - how? in his heart? Or did he start engaging with patina prior to Vmc approaching DJC/PA and B? How can a director even talk about acquiring something unless it was discussed by the board where A and B are members? Is it child play? Are you saying the other two directors seem incompetent, but now also H is? Because he’s talking about an acquisition with a third party without the board’s endorsement? And let’s say H has been talking with patina........with knowledge of A and B, the first reaction of A and B when approached by VMC should have been: sorry our spx is chasing that project, we cannot talk about this, please go somewhere else. - but instead they allegedly signed a CA. Lol

‘What is in public domain is not confidential.’ - correct, but they signed a CA not because of what’s in public domain, there may be thousands of info in public domain but Vmc came up with its Vmc specific research and assessments + Vmc specific confidential details of its offer or proposal. Otherwise since all words are in public domain, the dictionary, no one can compose a copyrighted song unless he uses words from Venus?

Vmc’s claims consist of multiple breaches which spx and/or its directors has to overcome to come out clean. Each breach will cost something. Patina has nothing to lose in speaking honestly as a witness but much to lose if they lie (not saying they will).

I guess it’s better for spx to keep quiet and bring all its ammunition’s at the trial instead as each claim they put forward in public in the last 24 hours to calm the market seems to strengthen vmc’s position and determination.

imo only. This could likely result in settlement not just to avoid costs but also to avoid embarrassment and tainted careers.

All the above are my guesses and speculations based on my layman’s view. And could all be wrong. For discussion only.
