Not correct.
There are hundreds of thousands of employees across the country who take up ESP every year. Employees include companies like Telstra, banks, O&G and others.
They don't get to renege on their contract.
It would be a serious issue with ASIC, if directors of companies get to renege, whilst other employees do not.
As to contract law, I am quite sure you misinterpret it.
Lastly, as a director of 4 companies, I know I do not have the option to renege.
