The hempbrokers.us lists the total THC (THCA + Delta 9) IMO
So long as Delta 9 is under 0.3% THC it is considered Industrial hemp and therefore saleable as CBD trimmed flower, IMO.
I have seen trimmed flower for sale in Colarado in 2018 with THC Delta 9 of 0.2% & THCA at 0.45% giving it a total of 0.65%.
