@m0ngy I'll reply in detail a bit later but in short, the Court is being practical - why try the whole case if there's no wrongdoing in the first place?
I suspect the judge will utilise the first phase of the hearings to establish if there was any wrongdoing on behalf of SPX and its directors. If not, the second set of the proceedings becomes defunct. I can only surmise that the submissions to date already point towards this outcome, hence the bifurcation despite VMCs objections.
The Court is keeping it simple and getting to the crux of the argument, setting a timeline and not clouding the issue - despite VMCs best efforts.
