Walk I'm not sure there is any guarantee FAR will be liable.
COP and WPL chose to close the transaction knowing there had been a dispute lodged.
I understand WPL going ahead as they had legal advice that said there were no applicable PE rights in this instance.......COP on the other hand I don't know, maybe WPL pressured them to deliver the asset.
