It is not the suspension per se. It is the matter in which the suspension was conducted. The ASX can suspend as per the listing rules, but they still have to abide by them as per ASX operating rules which includes part 7.2 of the Corporations act.
Firstly there has been an injustice in the sense that ISX are being treated as if they have done something wrong, before the investigation has even started. "Guilty until proven innocent", if you will.
Under the agreement between ASX and ISX they are entitled to a level of procedural fairness, which they have not been afforded.
