It would be interesting to be in court tomorrow over the argument about the actual or constructive knowledge of ANZ and ML about what representations were made to Opes clients, and what are the various legal consequences following from this.
It will also be interesting to see what view ANZ and ML lawyers take of the IMF action, as I understand it may have a slightly different slant in terms of its legal basis.
