Yes. I am speculating on the post arbitration outcome if they win a significant outcome. I reckon both sides want something from the other side. It is in everyone interest to negotiate an outcome. I disagree that vendor can walk away pain free and DNA has zero leverage over him at all if they win.
I am speculating on likely equilibrium outcome.
